authorising ad hoc prepetition committees to be appointed as statutory creditors’ committees and.allowing Chapter 11 plans to be filed with debtors’ petitions. In the process, it abandoned the Chapter X prohibition against prepackaged plans and incorporated several provisions to promote prepackaged Chapter 11 cases, such as: When Congress enacted the Bankruptcy Code in 1978, it consolidated the two reorganisation regimes into one overarching chapter: Chapter 11. The second, Chapter XI, which was intended to be used for arrangements involving unsecured debt and small non-public companies, retained the authorisation for a debtor to solicit acceptances prior to filing a bankruptcy case as long as the solicitation complied with applicable non-bankruptcy law. The first, Chapter X, which was intended to supplant the reorganisations that had previously been implemented through equity receivership proceedings, banned the solicitation of plan acceptances prior to the commencement of a reorganisation case. Seeking to address allegations that protective committees had (to the detriment of public bondholders) often come under the control of insiders and senior creditors, in 1938, Congress made provision for two distinct forms of bankruptcy reorganisation. The protective committee would thereafter propose a plan of reorganisation and seek its expeditious confirmation. An equity receivership proceeding involved the formation of a protective committee of bondholders (or other funded secured creditors), with all bondholders being offered the opportunity to deposit their bonds with the protective committee pursuant to the terms of a ‘deposit agreement’. Prepackaged Chapter 11 cases have their origins in 19th-century equity receivership practice. Īs a result, several options exist for prepackaged Chapter 11 cases, with all seeking to minimise the time that the debtor remains or operates in Chapter 11 by completing (or all but completing) the time-consuming task of negotiating and gaining acceptances to a plan of reorganisation prior to the filing of the Chapter 11 petition, but with each permutation permitting the debtor, as set forth herein, to address issues and circumstances specific to its financial situation and creditor body. The near four decades of experience that has resulted has given the US bar and bench the opportunity to refine the governing principles for prepackaged Chapter 11 cases. Prepackaged Chapter 11 cases have been widely used in the United States since the late 1980s and have become ever more prevalent in the last 10 years. Uninstalling an iPack is accomplished by selecting its entry in the Control Panel's Programs and Features section, or by running Command Prompt as administrator and entering sfc/scannow.If a company in financial distress is a US entity, or has sufficient contact with the United States to satisfy the jurisdictional predicates of the US Bankruptcy Code, that company will have access to a prepackaged plan process that is likely the most fully developed and sophisticated in the world. If installation of an iPack fails, try temporarily disabling any antivirus software installed on your PC. Install an iPack with the default Windows icons.īy installing any iPack included, you accept full responsibility for any damage including loss of data that may occur to your PC as a result. Always make a restore point before installing any custom icon packs. One last thing, please don't request me to port an icon pack that I haven't included, I chose these carefully and selected my own, or what ones I enjoy the most. Everyone will be able to find a color they like, all the bases should be covered in that regard. When I switched to Windows 10, I decided to finish what I started with my iPacks and to update them for better compatibility on Windows 10. In addition, I have included the File Explorer and Task Manager icons to be changed manually, since they can't be changed on newer versions of Windows.Īll in all these are the best and most up to date icon packs for Windows I have ever released. There are some limitations in iPacks, namely there will be missing icons in Control Panel and the icons in shell32 cannot be changed with iPack. Some of the older icon packs have been merged with the HUD icons so that there won't be many default icons to be seen with any of the packs. These icon installers were made using iPack Builder v2.2, Restorator and PhotoShop. Any recolors that weren't available on Windows 7 were done by me. They were all imported by me from their 7tsp counterparts originally for Windows 7. Mr GRiM and Razorsedge deserve full credit for creating the icon designs. I'm proud to share with you my collection of iPacks for Windows 10, which I have put considerable effort into testing, adding compatibility for Windows 10 and modifying the iPack UI.
